SYNAPSE – TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Synapse mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not install or use the App.

2. DESCRIPTION OF SERVICE

Synapse is a mobile AI chat application developed by KMTComputing Ltd. It enables users to:

Create and manage AI chat profiles
Connect to various third-party AI services (e.g. OpenAI, Ollama)
Conduct conversations with AI models
Store chats and profiles locally on their device
Securely store credentials using Apple's Keychain

3. LICENSE TO USE

Subject to these Terms, KMTComputing Ltd grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You may not:

Modify, distribute, or create derivative works
Reverse engineer, decompile, or extract the source code
Use the App for commercial purposes without written consent
Sell, sublicense, rent, or assign your rights to others

4. USER RESPONSIBILITIES

By using Synapse, you agree to:

Keep your API credentials secure and confidential
Use the App in compliance with applicable laws
Provide accurate profile information
Regularly back up data you do not wish to lose

You agree not to:

Use the App for any unlawful, abusive, or harmful purposes
Upload or generate offensive or illegal content
Interfere with or attempt to disrupt App functionality
Attempt unauthorized access or misuse the app's features

5. THIRD-PARTY SERVICES

Synapse connects to third-party AI and diagnostic services. Their privacy policies and terms govern any interactions with their platforms:

Other providers, as applicable

Analytics and Diagnostics

We use the following services for anonymized telemetry:

Firebase Analytics – Measures anonymized usage and engagement
Firebase Crashlytics – Reports crashes and performance issues

These services may collect:

Device type and OS version
Session data and screen usage
Crash traces and technical logs

KMTComputing Ltd does not collect or access personal identifiers.

6. INTELLECTUAL PROPERTY

All rights, title, and interest in the App (excluding user-generated content) are the exclusive property of KMTComputing Ltd. This includes all source code, design elements, branding, and documentation.

User-Generated Content

You retain ownership of content you create within the App
You are solely responsible for any such content
We do not store or access your content remotely

7. DISCLAIMERS

The App is provided "as is" without warranties of any kind, including:

Accuracy or reliability of AI-generated content
Availability, uninterrupted use, or security
Merchantability or fitness for a particular purpose

AI Disclaimer

AI responses may be unpredictable or inaccurate. We do not endorse or verify the output of third-party models. Use them at your own discretion.

8. LIMITATION OF LIABILITY

To the extent permitted by law, KMTComputing Ltd is not liable for:

Indirect, incidental, or consequential damages
Loss of data, business interruption, or reputational harm
Output generated by third-party AI providers

Maximum liability shall not exceed £100 GBP or the purchase price of the App, if any.

9. INDEMNIFICATION

You agree to indemnify and hold harmless KMTComputing Ltd from claims, liabilities, or expenses arising from:

Your breach of these Terms
Your use of the App in violation of applicable laws
Content generated or transmitted by you via the App

10. DATA PROTECTION & PRIVACY

Synapse is designed for privacy-first operation. Key principles:

All user data is stored locally on your device
Credentials are securely stored using iOS Keychain
We do not maintain user accounts or remote data storage
Third-party analytics are anonymized and limited

11. TERMINATION

We reserve the right to suspend or revoke access to the App without notice if:

You violate these Terms
You misuse the App or its features
The App is deprecated or withdrawn from distribution

Upon termination, local data remains on your device until deleted by you.

12. MODIFICATIONS

We may revise these Terms or the App at any time. Material changes will be communicated through:

In-app messaging
App Store release notes

Your continued use indicates your acceptance of the updated Terms. If you disagree, please uninstall the App.

13. AGE & JURISDICTION

You must be at least 13 years old to use the App
Users under 18 require parental consent
Use is restricted where prohibited by law

14. GEOGRAPHIC RESTRICTIONS

You are responsible for ensuring your jurisdiction allows the use of AI technologies and encrypted storage. The App is not available in regions where such use is restricted or unlawful.

15. FORCE MAJEURE

KMTComputing Ltd is not liable for failure to perform due to causes beyond its control, including but not limited to:

Natural disasters, power outages, or network disruptions
Third-party service outages or limitations

16. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

17. ENTIRE AGREEMENT

These Terms and the Privacy Policy represent the complete agreement between you and KMTComputing Ltd with respect to the App.

18. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of England and Wales.

Any disputes shall be resolved by:

Good faith negotiation
If unresolved, binding arbitration in the UK
No class actions permitted
